The Regulatory Process
The following information describes the disciplinary process as outlined by the Architects Registration Board.
Review
The Architects Registration Board reviews all complaints to determine whether they justify further action. Any complaint that is believed able to be dealt with without further investigation is brought to the attention of the architect for comment. The complainant may reply to the architect’s comments to achieve resolution to the situation. If the matter cannot be resolved at this stage the matter will then be passed on to the Investigations Panel.
Investigation
A formal investigation is presented to the Investigations Panel to determine all evidence and if the architect is responsible for professional misconduct or professional incompetence. The panel will be made up of an architect and two other members. On reaching a decision the matter will be dismissed and the architect advised on how to handle possible future situations in a more appropriate manner, or the matter will be referred to the Professional Conduct Committee if a case is warranted.
Hearing
A solicitor will prepare all evidence for a hearing with the Professional Conduct Committee. This panel will be made up of an architect, a solicitor and a member of the public. The architect has the right to representation, to submit and present evidence in their defence. If they are found guilty on the balance of probabilities, in any area of unacceptable professional conduct, serious professional incompetence, or both, the panel may impose a penalty.
Decision
The following actions may be enforced:
- A formal warning or reprimand
- A fine of up to £5,000
- Suspension from the register of architects for up to 2 years
- Removal from the register prohibiting the architect from working in the field indefinitely
Appeal
The architect can appeal to the High Court against any decision or judgement within 28 days of the decision.
