The Regulatory Process
The following information describes the disciplinary process as outlined by the General Chiropractic Council.
Investigation
The General Chiropractic Council gathers all relevant evidence, including information submitted by the chiropractor under investigation. An investigation committee will be responsible for the decision whether or not to continue proceedings. If the committee decides that sufficient evidence warrants further investigation, the matter is referred to the Professional Conduct Committee or the Health Committee for a full hearing.
Hearing
The hearing will be carried out within 9 months of the action in question. A solicitor is appointed by the General Chiropractic Council to present the case to a panel of 3 members, one of which must be a chiropractor. All evidence is presented, and the chiropractor must be given every opportunity to present a full defence, including calling witnesses wherever relevant.
Decision
If the chiropractor’s fitness to practice is proved to be diminished on the balance of probabilities, the following actions may be enforced:
- A warning may be issued
- Conditions or restrictions may be imposed for a specific amount of time
- A suspension may be issued
- The chiropractor may be dismissed indefinitely, prohibiting them from working in this field
Appeal
The chiropractor can appeal to the High Court against any decision or judgement within 28 days of the decision.
